Peakwell Trading e.K. provides ocean freight container management, logistics coordination, and consulting services for the transport of goods between Asia and Europe. The exact scope of services is defined in individual agreements and quotations provided to each customer.
All quotations issued by Peakwell Trading are non-binding unless explicitly stated otherwise. A contract is formed upon our written confirmation of the order. Verbal agreements require written confirmation to become effective.
All prices quoted are in Euro (EUR) and are exclusive of statutory value-added tax (VAT) unless otherwise stated. Invoices are due for payment within 14 days of the invoice date without deduction, unless otherwise agreed in writing. Peakwell Trading reserves the right to adjust prices in the event of significant changes in transport costs, currency exchange rates, or regulatory charges.
Peakwell Trading's liability for freight forwarding services is governed by the German Commercial Code (HGB), in particular §§ 407 et seq. HGB, and the General German Forwarding Conditions (ADSp) in their current version, unless otherwise agreed. Peakwell Trading is not liable for damages caused by force majeure, natural disasters, war, strikes, or other circumstances beyond our control.
Cargo insurance is not included in the standard scope of services. Customers are advised to arrange appropriate cargo insurance. Upon request, Peakwell Trading can arrange cargo insurance on behalf of the customer at additional cost.
Both parties agree to treat all business-related information obtained through the business relationship as confidential. This obligation survives the termination of the business relationship.
These terms and conditions are governed by the laws of the Federal Republic of Germany. The place of jurisdiction for all disputes arising from business relationships with Peakwell Trading e.K. is Hamburg, Germany.
Should individual provisions of these terms and conditions be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
